A short business trip can include a meeting, a training visit or delivery of a contracted service. Those activities do not necessarily belong under the same New Zealand visa, even when the traveller describes all of them as business.
In a 28 October immigration alert, Fragomen says changes effective from 20 October expanded permissible visitor activities and clarified Specific Purpose Work Visa categories for contractual service suppliers and independent professionals.
What a business visitor can do
INZ’s current Business Visitor Visa page includes informal business training limited to observation and theoretical instruction, without a formal qualification. It also lists certain transactions by people in management or financial-services roles and participation in tourism conventions by specified travel professionals.
The category generally allows up to three months in a year. Other entry arrangements apply to eligible visa-waiver travellers and Australian citizens. Having an acceptable purpose does not remove the remaining entry, funds, health or character requirements.
Delivering a service has different conditions
The Specific Purpose Work Visa guidance sets detailed requirements. Contractual service suppliers must fulfil an overseas employer’s contract with a New Zealand client in an ANZSCO skill-level-one role. Requirements include a qualifying degree, six years’ relevant experience and at least one year with the supplying enterprise.
Independent professionals must be self-employed, have a qualifying service contract in a skill-level-one-to-three occupation and meet qualification and experience requirements. Skill-level-three roles have English requirements, and evidence of attempts to recruit a New Zealander is required. Registration and qualification assessment can also matter.
The published guidance allows these service categories stays of up to 12 months, subject to the applicable conditions. It includes restrictions on repeat applications for the same service and client, and does not allow these categories to support partner or dependent-child visas based on the relationship.
Describe the activity before choosing the visa
Fragomen describes the changes as clearer options for defined temporary work, rather than unrestricted access to the labour market. A traveller should set out the actual tasks, contract, payment and duration, then check the official category against that plan. A host calling a project a visit does not determine its immigration treatment.
